Billionaire Elon Musk has moved to dismiss his lawsuit against ChatGPT creator OpenAI and its CEO Sam Altman, which accused them of abandoning the startup’s original mission of developing AI for humanity’s benefit rather than profit. Musk’s attorneys requested the California state court to dismiss the case without providing a reason, allowing for the possibility of refiling in the future.

The lawsuit, filed in February, marked Musk’s opposition to OpenAI, a startup he co-founded. Musk alleged that OpenAI shifted from its nonprofit origins to a profit-focused entity, particularly criticizing the release of its powerful language model GPT-4. He sought to force OpenAI to make its research public and prevent it from using its assets for financial gain.

OpenAI countered, describing the lawsuit as an attempt by Musk to benefit his own AI interests. Musk, who founded his AI startup xAI last year, dismissed the case without prejudice. The court was set to hear OpenAI’s motion to dismiss the lawsuit on Wednesday.

The legal battle underscored the tension between Musk and OpenAI, which has secured significant funding from Microsoft and become a prominent name in generative AI.
